Policies, Terms, & Legal Information
Clients are to read and understand all of the available information on northfaun.ca and to ensure they have contacted North Faun for any additional clarification required prior to ordering. By completing a transaction through North Faun, clients agree to the policies and terms as well as legal information listed below.
NORTH FAUN POLICIES & TERMS
1. Prior to purchase the client is responsible to have:
- read and understood the policies, FAQ, design information, sending instructions, applicable listings, and all other information provided on northfaun.ca, and to have contacted North Faun prior to placing an order for clarification if required
- ensured they are providing the correct ring size and have fully understood all design measurements, and to have contacted North Faun prior to placing an order for clarification if required
- made arrangements to be able to provide their inclusions to the North Faun studio promptly, which is up to 30 days from the time of purchase, and confirm that they are not providing the sole amounts of their materials for gem creation
2. After purchase, the client is responsible to:
- ensure delivery of their inclusions to the North Faun studio within the agreed upon timeframe (ie. within 30 days of purchase)
- inspect their completed piece immediately upon delivery and make North Faun aware of any issues with their piece within 5 days of receipt based on the delivery information provided by the tracking information
- read and understand the care guidelines to provide proper care to their piece and to ensure its lasting quality, to request further information from North Faun regarding care when required, and to check their settings and gems regularly prior to wear for any issues to ensure that they do not lose their gem
3. In comissioning a design, the client agrees that:
- by completing a purchase through North Faun that they are commissioning a custom created piece of wearable art in the form of a handcrafted jewellery setting with a custom created gem using their own personal inclusions which they are responsible to send in at their own cost
- being a custom piece of art using client-provided materials, there may and likely will be small to large variances in the piece they receive compared to sample photographs provided on any platform maintained by North Faun.
- commissioned items may be photographed, with these photographs potentially being used for: cataloging, display on any site operated by North Faun, social media, or any other use deemed appropriate by the creator
- the inclusions that they provide will play the dominant role in the appearance of their finished piece
- issues arising due to unclear or incorrect instructions given, an incorrect ring size ordered, failure to ensure a full understanding of the gem size or other measurements provided, disconnect between expectation of the final colour of inclusions and reality, or any similar scenario are not the responsibility of North Faun
4. Refunds & Returns
- due to the highly personal and completely customized nature of the purchase, no refunds for completed or in-progress pieces can be provided. For the same reasons, typically no returns are accepted
- returns are considered for items that arrive to the client which have been incorrectly created, however this strictly does not apply to scenarios such as those noted in Section 3. Items considered for a refund must be agreed upon between the client and North Faun, and returned to the North Faun studio in a reliably traceable manner and must return in the same condition and packaging in which they were originally sent
5. Cancellations
- cancellations to a standard order may be submitted within 5 business days of the time of order and will receive a full refund. Cancellations requested after 5 business days will be provided minus 30% of the purchase price, to cover materials ordered specifically for you and work already tendered. No cancellations are accepted after your inclusions have arrived at the studio. For standard orders with packages that have not arrived at the North Faun studio within 90 days of purchase, a cancellation with a refund minus 30% of the purchase price may be initiated by North Faun on your behalf . Cancellations cannot be provided at any time in the instance that North Faun has agreed with the client to create a customized setting of any type, including those with personalized engravings or client-selected gemstones. In instances of a customized setting where client-provided materials have not arrived at the studio within 180 days, North Faun will ship the client's setting without a custom keepsake gem with no refund, partial or otherwise, provided.
6. Warranty
- a setting warranty of 45 days is provided against manufacturing defects, beginning from the date of customer receipt, as any failure in the fabrication process will certainly be evident within this timeframe. Breakage or failing parts of your setting within this time that happen with normal wear will be deemed to be a manufacturing fault and fixed at no cost
- clients are required to inform North Faun of any potential warranty claims as soon as they are evident, and such items within the warranty period are required to be returned to the North Faun studio within 14 business days of the end of the warranty period in a reliably traceable manner, or the warranty offer is considered void. The piece will be inspected for a determination of whether it appears to be a manufacturing defect or the result of poor/abusive wear or care. Items that do not appear to have failed due to a fabrication error will require the client to provide for shipping to and from the studio as well as any labour and material fees as required, as determined by North Faun
- warranty does not include rough, abusive, or otherwise inappropriate handling, wear or care. Breakage or failing parts after the warranty period will not be considered a manufacturing defect and do not fall under the responsibility of North Faun. These items may be able to be fixed for a fee
- gems are provided as-is, with no warranty assumed as the lifespan of the gem strictly correlates to the care it is provided. Gems are durable and will last if provided proper care. North Faun holds no responsibility due to rough, abusive, or otherwise inappropriate handling, wear or care, nor does North Faun hold any responsibility in the case of lost jewellery or gems
- having agreed to the customer responsibilities in Section 1, clients have reserved a portion of their inclusion at home and in the case of a lost gem may agree with North Faun to provide the original setting and an additional amount of their inclusion to the North Faun studio for gem recreation service for a fee plus shipping
PRIVACY STATEMENT & LEGAL INFORMATION

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.
SECTION 2 - CONSENT
How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

SECTION 3 - DISCLOSURE
We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
SECTION 4 - SHOPIFY
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
Payment: If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. SECTION 5 - THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

SECTION 6 - SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
SECTION 7 - COOKIES
Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.
_session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).
_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits
_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer. Cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.
_secure_session_id, unique token, sessional storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us.
